In Russian legislation, the concept of “minimum pension” does not exist in any of the formulations of legislative acts. However, in order to establish the minimum allowance for an elderly person, our country has established the so-called pensioner’s living wage (PMP), which determines the minimum amount on which an elderly person can live in the current economic situation at the moment. According to the draft law, this parameter is divided into federal and regional. Each region legally has the right to establish its own PMP. If a person’s pension does not reach the regional PMS in his region, then according to the law he has the right to apply to the social protection authorities to receive a social supplement up to the level of PMS in his region.

Taking into account the fact that real incomes of the population have been falling for the fifth year in a row. Prices are rising every year. It is worth noting that the inflation declared by the Central Bank and the Ministry of Finance does not match the real one, which is several times higher than the declared one. In 2020, due to an increase in VAT to 20%, the cost of many products in general may increase by approximately 15-30%. - Choose a convenient way to receive funds.
Hint: you should inform the Fund’s specialists about a long-term inability to receive money. If a citizen does not withdraw them from the card for more than six months, accruals may be suspended.
Conditions for assigning pension payments in the Stavropol region
The conditions vary depending on what type of payment is assigned.
To receive an old-age pension you need:
- reaching the established age (in 2020, due to the reform, this indicator changed, for women the minimum limit is 55.5 years, for men - 60.5, in 2020 these values will be 56.5 and 61.5, respectively);
- having a minimum of 10 years of experience (next year you need to have 11 years of work experience);

There is also a type of state pension for long service. These funds are intended for individuals who are federal government employees, military personnel, pilots, or astronauts.
Disability pensions for residents of Stavropol can only be granted if certain conditions are met.
These include:
- insurance amounts are assigned to citizens with disabilities who have worked for at least 1 day;
- Social benefits are available to persons recognized as disabled and who have not previously worked a single day.
The state version of the disability pension is awarded to citizens who served in the military and suffered as a result of radiation and man-made disasters.

Those born no later than 1966 are entitled to such payments.

on unlawful actions of the bailiff
(in accordance with Article 441 of the Code of Civil Procedure of the Russian Federation) on December 15, 2010, by the bailiff of the bailiff department for the Kirov district of the city of Tomsk, the Federal Bailiff Service for Technical Services (Yeniseiskaya st., no. 33) Yakobi S.A. As part of the initiated enforcement proceedings (No. 69/1/47635/2/2010), a decision was made to foreclose on the debtor’s pension in the amount of 50% (the claimant is the so-called credit consumer cooperative “First Tomsk”).
I consider the decision of the bailiff to be illegal and subject to cancellation due to significant violations of the norms of the Constitution of the Russian Federation and the Federal Law “On Enforcement Proceedings”.
1. Violation by the bailiff of Articles 2, 7, 18 of the Constitution of the Russian Federation.
The Constitution of the Russian Federation, in accordance with the goals of the Russian Federation as a social state, whose policy is aimed at creating conditions ensuring a decent life and free development of people (Article 7), guarantees everyone social security by age, in case of illness, disability, loss of a breadwinner, for education children and in other cases established by law.
The bailiff's decision, unmotivated and unfounded by its “calculations,” deprives the provisions of the fundamental law of the state of any meaning.
2. Violation by the bailiff of Article 55 of the Constitution of the Russian Federation.
In accordance with Part 3 of Article 55 of the Constitution of the Russian Federation, the rights and freedoms of man and citizen can be limited by federal law only to the extent necessary in order to protect the foundations of the constitutional system, morality, health, rights and legitimate interests of other persons, ensuring national defense and state security.
Within the meaning of Article 55 (Part 3) of the Constitution of the Russian Federation, the introduction of liability for an offense and the establishment of a specific sanction limiting constitutional law, based on general principles of law, must meet the requirements of justice, be proportionate to the constitutionally enshrined goals and protected legitimate interests, as well as the nature of the crime committed. acts (from the Resolution of the Constitutional Court of the Russian Federation of July 30, 2001 N 13-P). Of the two “protected legitimate interests” - the right to life and health of the debtor on the one hand and the “right” of a non-profit organization to commercial excess profit on the other, preference is given to the latter by civil servants!?
3. The bailiff violated the requirements of Art. 2, 7, 17, 18, 35, 38 of the Constitution of the Russian Federation, Articles 2, 3, 4 of the Federal Law “On Enforcement Proceedings” (ignoring a legally significant circumstance - the financial situation of the debtor).
The debtor's monthly pension is 7,400 rubles. This amount of “social payment” from the native state is not enough for the debtor to even pay for food! The debtor's monthly expenses also include: payment of utilities, purchase of medicines (1500-2000 rubles), repayment of loans. Taking into account the property status of the debtor, the nature of the offense committed, as well as the degree of his guilt, the chosen measure of execution of the court decision is in direct contradiction with the principles of building a legal state proclaimed by the Constitution and Federal Law No. 119 and the purpose of the institution of enforcement proceedings.
4. Violation by the bailiff of the requirements of Article 4 of the Federal Law “On Enforcement Proceedings” (Principles of Enforcement Proceedings).
This norm of the federal law establishes the principle of enforcement proceedings - the principle of inviolability of the minimum property necessary for the existence of the debtor-citizen and his family members. While foreclosure on the debtor's wages, the bailiff from Tomsk offered to "live on" the woman's pension of 3,700 rubles "until the debt is fully repaid" in the amount of 396,868 rubles! Exactly 101 years!
5. In violation of Part 2 of Article 14 of the Federal Law “On Enforcement Proceedings”, the bailiff’s resolution does not contain valid information on the merits of the decision being made (it is stated: “the debtor has income in the form of wages”).
Based on the above, guided by art. 441 of the Code of Civil Procedure of the Russian Federation, I ask the court to recognize the action of the bailiff S.A. Yakobi. on the issuance of a resolution dated December 15, 2010 on the illegal execution of the debtor’s “wages” and to cancel the said resolution.
At the same time, I ask the court to restore the deadline for filing this complaint due to the late receipt of a copy of the appealed decision.

The size of the pension in the Stavropol Territory in 2020
The minimum pension must be no less than the minimum subsistence level in force in the territory of the subject in question.
