Refusal to spend MSC funds

After the application (and other documents necessary in this case) is submitted to the authorized body, its employees review the documentation, check the specified information, and then make a decision - to give permission to spend the funds on the balance of the certificate, or to issue a reasoned refusal.

Often the reason for refusal is simple inattention of the person filling out the application, which resulted in errors. In this regard, you must be very careful when preparing this document, and if you make mistakes, take a new form and re-enter the information without correcting it in the previous document, since corrections are not allowed.

In addition, other circumstances may be the reason for refusal to spend funds:

  • The certificate holder has already spent the funds on the balance.
  • The amount remaining on the certificate balance is less than what the applicant requests.
  • The certificate holder has lost the right to use the certificate (for example, he was deprived of parental rights, committed a crime against the child’s personality, and so on).

Refusal to spend funds must be in writing. If the applicant does not agree with the reason for its issuance, he may, in order to protect his rights, file a complaint with the court and/or a higher authority.

Mortgage

To submit to the Pension Fund you will need:

  1. mortgage insurance policy;
  2. information from the bank about the property being pledged;
  3. mortgage agreement.

Participation in shared construction

PF will consider:

  • a copy of the agreement with the developer;
  • obligation of the developers, notarized, regarding the timing of registration of the property as the property of the buyer.

Acquisition of a share of real estate

After the share is redeemed, all residential premises must belong to the owner of the certificate . For example, this is possible when a family owns half of the apartment, and at the expense of maternity capital, registers ownership of the second half of the home.

The law prohibits the purchase of a share in a property that will have multiple owners after the transaction is concluded.

The set of documents does not differ from the main package, however, a certificate of ownership must be issued for the purchased share.

In installments from the developer

The application to the Pension Fund must be accompanied by:

  • original or copy of the share participation agreement;
  • information about the progress of payments and the balance amount.

Application Form

When filling out the application form, you must strictly follow the rules described in the legislation.
In the application, in line (1), the applicant’s data, his surname at birth, status (mother, father, child) and SNILS number in line (3) must be indicated. Important! Only the person specified in the certificate has the right to submit an application for disposal of maternal capital. An exception is the death of the certificate holder or deprivation of his parental rights. When changing your last name, first name or patronymic, or passport data, you must contact the Pension Fund to put a mark in the certificate about the change in the relevant data. In line (2), the date of birth is entered only if the applicant is a child entitled to such a measure of state support.

Next, lines (4), (5), the series, certificate number, by whom and when it was issued must be indicated. Below, in the corresponding lines under number (6), you should indicate the passport details of the applicant; if the applicant does not have a Russian passport, then indicate an identification document of a person on the territory of the Russian Federation, permitted by the legislation of the Russian Federation.

Lines (7) indicate the applicant’s registration address, his place of stay or address, if they differ. It is necessary to indicate the full address, including the postcode of the place. You should also indicate the applicant's contact phone numbers.

Line (8) must indicate the date of birth of the child, or adoption, in connection with whose birth (adoption) the right to receive a certificate for maternal capital arose.

Lines (9), (10) and (11) are filled in if an application for disposal of maternal capital funds is submitted by a representative of the applicant. It is mandatory to indicate complete and accurate details of the document confirming the authority of the representative.

Next comes block (12), in which we write down the purpose of disposing of funds. The directions for disposition are clearly specified by law; it is better to rewrite the reason directly from the text of the federal law. A list of directions is provided by both the Pension Fund and the MFC when filling out an application. These lines also indicate the amount of funds allocated; their amount must exactly correspond to the documents attached to the application. In this case, a difference of even a few kopecks may result in a refusal by the Pension Fund, and the documents will have to be collected and filled out again. If you have already managed maternity capital funds, then it is better to obtain a certificate about the balance of maternity capital funds so that the amount of funds requested does not exceed the available one. In this block, you need to fill out information about whether you have previously managed funds from maternal capital and confirm that you are not deprived of the opportunity to use funds from family capital.

Do not forget to sign the lines stating that you are familiar with the Rules for the allocation of maternal capital funds, they are approved by the Resolutions of the Government of the Russian Federation. You should also sign confirming the accuracy of the information you provide.

Attention! After the text of the application there is a block in which you must list all the documents that you attach to the application; it serves as an inventory. After filling it out, you must put the date of application and signature in the appropriate lines.

At the end of the application there is a receipt-application, which is filled out by a person authorized to accept documents and handed over to the applicant. The receipt must indicate the assigned application number, the details of the applicant, the date of receipt of the application and the details of the person who accepted your application for disposal of maternal capital funds.

The application must be accompanied by a completed Appendix. There are only five of them and each corresponds to a separate area of ​​family capital management. You need to select the appropriate one and fill it out. The absence of an Appendix to the application means that the application is not completely completed.

The application for the disposal of maternal capital on the government services website is filled out in the same way. Pay attention to the pop-up tips when filling out the application. To proceed to the application, select the application option that suits you on the website and click “Get a service”. Please note that to receive the service, you must have an account with the 3rd level of identity verification.

There are the following options for submitting documents in 2020:

  • Internet portal of public services;
  • come to the Pension Fund in person;

  • submit documents to the MFC.

By choosing the method of transmitting documents electronically, the applicant will undergo the registration procedure according to the approved program. However, you need to be prepared for the fact that you must first register on the site and gain the right to sign electronically.

How the application is reviewed

The process takes place in accordance with Federal Law No. 256 and takes place in several stages:

  • an application is submitted for the use of maternity capital;
  • review within 30 days;
  • obtaining a positive decision;
  • transfer of funds within 10 days.

How to manage the issued money

After a positive or negative decision is made, parents are notified in writing. Then the Pension Fund transfers the funds to the account specified in the Appendix to the Application for the disposal of maternal capital funds.
If the applicant has requested partial use of funds, the remaining funds will be received at a later date. To do this, you need to collect the papers again. When using maternity capital partially, the Pension Fund gives the certificate back to the applicant after making a decision on the disposal.

Attention! The allocated funds are used after the child turns three years old. Only for some of the areas specified in the legislation are they allocated earlier than this deadline.

Documents and requirements from the seller of the property

To receive payment from the Pension Fund, the seller must open an account with Sberbank.

Documents from the owner for the transaction:

  1. owner's identification card;
  2. confirmation of ownership of a housing property;
  3. the agreement on the basis of which the certificate of ownership is issued;
  4. Form 9 about registered residents;
  5. notarized permission of the spouse for the purchase and sale of real estate;
  6. Bank details.

To submit to the MFC for the purpose of registering a completed transaction, you will need:

  • agreement between buyer and seller;
  • form 9;
  • a document from the guardianship authorities stating that the rights of minors have not been violated;
  • passports of all owners;
  • document confirming the consent of the spouse.

To submit to the Pension Fund you will need:

  • contract of sale;
  • receipt for receipt of funds from the buyer;
  • information from the passport office about registered residents;
  • a certificate from the accounting department of the passport office confirming that there are no debts for utility bills;
  • registration certificate of the residential premises;
  • permission from guardianship authorities;
  • extract from the Unified State Register of Real Estate;
  • certificate confirming mental health (may be required in some cases by buyers or representatives of the PF).

What is the deadline for transferring maternity capital when purchasing a home in 2019?
