Maternity capital is an instrument of state support that is provided at the birth (or adoption) of a second or subsequent children. The program has been operating for about 10 years; initially it was aimed at increasing the birth rate. Payments have a specific purpose: they can only be spent on activities listed by law.

Over the years of use, more than 6.5 million Russian families have used maternity capital. The official deadline for completing incentives to improve the demographic situation in the country is December 31, 2018. In this regard, a number of questions arise: will it be decided to extend state support for fertility, what will be the amount of maternity capital in 2020, will it be abolished?

How are benefits paid from maternity capital funds?

The main changes to the procedure for receiving maternity capital funds introduced by the Federal Law “On Monthly Payments to Families with Children” are to provide the opportunity to receive monthly payments in the form of benefits from maternity capital funds for the second child. You can spend the money paid in the form of benefits for your second child for any purpose. A family applying for payments must meet the following conditions:

  • the parents (adoptive parents) of the child are citizens of the Russian Federation permanently residing in the country;
  • the child was born (adopted) after January 1, 2020 and is a citizen of the Russian Federation;
  • The average per capita family income should not be more than 1.5 times the subsistence level in the region of residence of the family for the second quarter of the year preceding the application (in accordance with paragraph 2 of Article 4 of the Federal Law of October 24, 1997 “On the subsistence level in the Russian Federation”) Federation");

The bill adopted by the State Duma solves two problems at once:

  1. The measures taken can help improve the demographic situation in the country;
  2. In the difficult economic conditions that are observed today, families can count on material support from the state.

Thus, from January 1, 2020, families in which the first or second child is born will be able to receive monthly payments. This rule also applies to adopted children. Families in need will be able to receive payments until the child reaches the age of 1.5 years .

The amount of the benefit will be calculated based on the cost of living established in the applicant’s region of residence. Moreover, the calculation will be based on the indicator of the second quarter preceding the year of filing the application.

It is difficult to say exactly what amounts will go to the applicants’ accounts. However, the head of the Ministry of Labor M. Topilin announced estimated figures. The size of payments will vary from 8,000 to 20,000 rubles. The average in Russia will be about 10,500 rubles per month . The highest rates will be in Chukotka and the Nenets Autonomous Okrug.

Financing will come from the federal budget. For these purposes, the following plan has been developed:

In order to take advantage of the support provided at the birth or adoption of the first child, the applicant must contact the social protection authorities in the region where the family is registered.

If a second child appears in the family, then the place of application will be the Pension Fund in the region where the family lives.

It is worth noting that MFCs are currently operating throughout the country. Multifunctional centers provide one-stop services for receiving documents from various government agencies. In this regard, another place for citizens to submit applications for benefits will be the MFC.

In order to benefit from state support, a family must meet certain requirements:

  • The measures apply to families in which a child was born or adopted after January 1, 2020. Moreover, he must be a citizen of the Russian Federation;
  • Family income is taken into account. It should not exceed 1.5 times the subsistence level of the population established in the applicant’s place of residence. The calculation is based on the indicator of the second quarter of the year preceding the year of application.

If a second child is born in the family, then documents for receiving a monthly benefit are submitted along with a package of documents for receiving maternity capital.

How to apply for payment?

Maternity capital in 2020, the amount of which is 453,026 rubles, can be received in the form of payments for the second child on the basis of a citizen’s application for a monthly payment and documents, the package of which is currently not finalized, but an approximate list is given in Appendix 2 to Order of the Ministry of Labor of the Russian Federation “On approval of the procedure for making a monthly payment in connection with the birth (adoption) of the first or second child, the procedure for applying for the appointment of the specified payment, as well as the list of documents necessary for assigning a monthly payment in connection with the birth (adoption) of the first or second child."

The application and necessary documents are submitted at the place of residence, including with the help of a representative, to the territorial body of the Pension Fund of the Russian Federation (can be submitted simultaneously with the application for a certificate for maternal capital) or through the MFC. Applications and documents will not be accepted after 1.5 years from the child’s birth. After 1 year has passed since the start of receiving payments, it will be necessary to repeat the procedure for submitting the application and documents. Payments are transferred to an account opened with a Russian credit institution.

If a second child appears in the family, then obtaining a certificate for the right to use maternity capital is not particularly difficult. You just need to provide the following list of documents to the pension fund department:

  • Application for a certificate. It can be obtained directly from the Pension Fund, or
  • Passport
  • Birth certificate for all children;
  • For children who were adopted - a court decision on their adoption;

They may also require additional documents in case of non-Russian citizenship of the spouse. If you have any doubts, you can always consult directly with the Pension Fund branch itself. After successful verification of documents, usually within a month, the applicant will receive a certificate for maternity capital.

What documents are submitted along with the application for payment?

An approximate list of documents submitted along with an application for a monthly payment in connection with the birth (adoption) of a second child includes the following:

  • the name of the territorial body of the Pension Fund of the Russian Federation to which the application is submitted;
  • last name (received at birth), first name, patronymic of the applicant and child;
  • date of birth of the applicant and the child;
  • information about the identity document;
  • information about the place of residence based on a document confirming registration at the place of residence;
  • information about the applicant’s representative, including passport data and power of attorney data;
  • information about the existence of the fact of deprivation (non-deprivation) of parental rights in relation to the applicant’s child, the adoption (non-acceptance) of a decision to cancel the adoption of the child (children), to select the child (children));
  • information about the existence of the fact of committing (non-committing) an intentional crime against the person in relation to the applicant’s child (children);
  • information about the applicant’s family income;
  • details of the applicant's account opened with a Russian credit institution;
  • list of attached documents.

Maternity capital: new opportunities for families with children from 2020

Since January 1, 2018, a number of significant additions have been made to the maternity capital program, initiated by the President of the Russian Federation Vladimir Putin as part of the implementation of the National Strategy for Action in the Interests of Children.
Changes made to the federal law “On additional measures of state support for families with children”, which has been in force for more than 10 years, are aimed at maintaining positive demographic trends in the country. Extension of the validity period of the maternity capital program

The opportunity to join the maternity capital program has been extended until December 31, 2021. That is, to obtain the right to maternity capital, it is necessary that the child who gives the right to the certificate be born or adopted before December 31, 2021. At the same time, the receipt of the certificate and the disposal of its funds are not limited by time.

The main directions for using maternity capital remain the same: improving living conditions, paying for educational services for children, forming the mother’s future pension and paying for goods and services for social adaptation and integration of disabled children into society. You can apply for a certificate and manage its funds through the citizen’s Personal Account on the Pension Fund website or the government services portal.

Let us remind you that the maternity capital program has been in effect since 2007. During this time, in Mari El, 45,502 families with two or more children received a certificate for maternity capital. Almost half of them have already used the funds in full.

The most popular area for spending maternity capital is improving housing conditions; 34,634 families took advantage of it. 1,869 families paid for the education of older children in higher and secondary educational institutions and the maintenance of children in kindergartens.

State support for families from the federal budget since the beginning of the program amounted to 13.6 billion rubles, of which almost 13 billion rubles were spent on improving housing conditions, and 44.4 million rubles were spent on education.

A significant support for families with children was the opportunity to receive a lump sum payment for everyday needs using maternity capital funds. In 2009–2011, its size was 12 thousand rubles, in 2020 – 20 thousand rubles, in 2020 – 25 thousand rubles. In Mari El, 38,316 families received a one-time payment totaling more than 630 million rubles.

The amount of maternity capital has increased from 250,000 to 453,026 rubles since 2007, or 1.8 times.

Maternity capital – for children’s education

The three-year moratorium on the disposal of maternity capital for preschool education of children has been lifted. From January 1, 2020, maternity capital funds can be used to support kindergarten and receive additional preschool educational services from the birth of a child, without waiting until the age of 3.

In addition, the mandatory accreditation of the educational program has been abolished. Now, using maternity capital funds, you can pay for the services of any educational organization with the appropriate license.

Monthly payments from maternity capital funds

Low-income families in which a second child (their own or adopted) was born after January 1, 2020 will be able to receive a monthly payment from maternity capital funds. Low family income means income that does not exceed 1.5 times the subsistence level of the working-age population in a constituent entity of the Russian Federation. The size of the payment also depends on the region - it is equal to the subsistence minimum for children, which was established in the constituent entity of the Russian Federation for the second quarter of the previous year. If a family applies for a payment in 2018, its amount will be the subsistence minimum for children for the second quarter of 2020.

In Mari El, recipients of such payments in 2020 can be families with an average per capita income of up to 15,070.5 rubles, and the payment amount will be 9,645 rubles. Monthly payments are established until the child reaches one and a half years old.

When calculating the total family income, salaries, bonuses, pensions, social benefits, scholarships, various types of compensation and other payments are taken into account. When applying to the Pension Fund, the amounts of these payments must be confirmed by relevant documents, with the exception of payments received from the Pension Fund. The calculation does not take into account the amount of one-time financial assistance from the federal budget in connection with emergencies, income from bank deposits and rental of property.

To understand whether a family is eligible for payment, you need to take the total amount of family income for the last 12 calendar months, divide it by 12, and then divide it by the number of family members, including the second child born. If the amount received is less than 1.5 times the subsistence level of an able-bodied citizen (in Mari El - 15,070.5 rubles), you can go to the Pension Fund and apply for a monthly payment.

You can apply for a monthly payment at any time within one and a half years from the date of birth of your second child. If you apply in the first six months, the payment will be established from the date of birth of the child, that is, funds will be paid including the months before the application. If you apply later than six months, the payment is established from the date of submission of the application.

An application for a monthly payment can be submitted to the Pension Fund client service or through the MFC. Moreover, the mother can submit two applications to the Pension Fund at once: to receive a certificate and to establish a payment. At the same time, you can apply for SNILS for your child. The law gives the Pension Fund a month to consider the application and issue a certificate for maternal family capital and another ten working days to transfer funds. The money will be transferred to the bank account of the certificate owner.

A monthly payment is not assigned if children are fully supported by the state, if false information about family income is provided, as well as for citizens who are deprived of parental rights.

Monthly payments are made until the child reaches one and a half years old, but the first payment period is designed for a year. After this, you need to reapply for her appointment. Payments stop if maternity capital is fully used, the family changes place of residence, or the child is one and a half years old. Payments can be suspended if necessary.

Latest news and changes

The adopted law also provides for another opportunity to submit an application for the disposal of maternity capital funds from the date of birth of the child, without waiting for the child to reach 3 years of age: to pay for educational services of preschool education. Previously, in this way it was possible to manage only funds to pay the down payment and (or) repay the principal debt and pay interest on loans or borrowings for the purchase (construction) of residential premises, including mortgage loans, as well as for the purchase of goods and services intended for social adaptation and integration into society of disabled children.

From December 31, 2017, it is possible to obtain information in writing or in the form of an electronic document about the amount of maternity capital funds and the balance of funds (Federal Law of December 20, 2017 N 411-FZ).

And on May 31, 2020, Prime Minister Dmitry Medvedev signed a Decree of the Government of the Russian Federation, which allows refinancing, at the expense of maternity capital, credit debt on principal and interest that arose before the birth of the second child or subsequent children giving the right to maternity capital, and after birth.

What can you spend maternity capital on?

The very formulation “spend maternity capital” is not entirely correct. It would be more correct to say “send”, since in most cases the family will not see real money. She only makes a decision, and the Pension Fund transfers the funds. Here's what you can spend your money on.

Improving living conditions

Money for a down payment on a mortgage when buying or building a home can be used immediately after the birth of a child. A similar rule applies to repaying a mortgage loan and interest on it. If the family intends to do without credit funds, then they will have to wait until the baby’s third birthday.

Child's education

Money for a paid nursery or kindergarten can be spent immediately after the birth of the child. For other education - only after three years.

Adaptation of disabled children

The list of Order of the Government of the Russian Federation dated April 30, 2020 No. 831-r of goods and services for which maternity capital funds can be allocated has been approved by the government. You can spend money immediately after the birth of a child, thanks to whom you received a capital certificate.

Mom's pension

Money is allowed to be used to form the funded part of an old-age pension, but only after the child’s third birthday.

Monthly payments for the second child

A family in which the average per capita income is less than two subsistence minimums per person can apply for benefits Federal Law No. 418-FZ dated December 28, 2017. It is paid for the first and second child. Only payments for the first baby come from the federal budget, and for the second - from maternity capital. The benefit is equal to the regional subsistence minimum per child.

Timing of the program

From the beginning of 2006, it was decided that the program for using maternity capital would run until 2020, but then the period was increased to 2020. at a time of favorable development of the Russian economy, the state could afford to provide subsidies to young families, but even then the question arose of how long this would last.

Oddly enough, even the economic difficulties of 2020 did not affect the payment in any way; it was not reduced, but in 2020 they simply decided not to index it, since there were already not enough funds in the federal budget. Until December 31, 2020, the program will continue to operate and families who have a second or third child will be able to receive their subsidy.

This provision is already enshrined in law and cannot be revised. It is worth saying that the time limits limiting the receipt of maternity capital relate only to the time of acquiring the right to the certificate itself. If a person has previously received a subsidy, but did not have time to use it, this can be done at any time convenient for him. Thus, the restriction does not apply to children already born and the possibility of using the certificate after 2018.
