Maternity capital for studies: features of the direction of funds

Parents have the right to allocate funds from the MK for the education of one child or all children at the same time, at their request. At the same time, the following conditions for using the certificate in 2020 should be taken into account:

Maternity capital for education: list of documents and deadlines

An application for the disposal of MSC funds for the education of children and other expenses associated with obtaining an education, which is accepted by the territorial body of the Pension Fund of the Russian Federation, can be canceled at the request of the citizen who received the certificate.

Important! The funds will be transferred not to the parents’ bank account, but to the account of the institution or educational organization where the child is studying, on the basis of an agreement. The pension fund never provides such assistance in cash.

According to the rules, you can spend maternity capital on children’s education. Despite the fact that this type of assistance is issued after the birth of the second or subsequent children, the funds can be used to pay for the education of any child. Educational institutions working with the program include:

How much money from maternity capital can be spent on a child’s education?

In 2020, the amount of maternity capital is 466,617 + 150,000 rubles. for the first and second child in rubles, provided that the parents have not previously used funds from the certificate. The law does not establish restrictions on the amount of payment for child education expenses. In fact, parents can spend all the money available on the certificate, resetting it completely.

How to pay for the education of an older child with maternity capital

When using maternity capital funds to pay for the education of an older child, the following conditions must be met:

  • the educational institution must be located on the territory of the Russian Federation;
  • the child must be no more than 25 years old at the start of training;
  • the youngest child entitled to a certificate must be 3 years old.

The procedure for using maternity capital for paid educational services can be presented as a simple

  1. An agreement on training on a paid basis is concluded between the certificate holder and the educational organization, and specific payment terms may be specified:
      directly in the text of the agreement;
  2. in an additional agreement to the contract.
  3. Copies of the following documents are certified and must be provided by the educational institution:
      license to carry out educational activities;
  4. state certificates accreditation for the chosen educational program.

The accreditation of a university or college itself does not guarantee that all educational programs implemented in it are also accredited (this is especially true for new, newly opened areas of training, for which there has not yet been the first graduation of specialists).

The certificate can be used to pay for training in any educational organizations that implement professional training programs:

  • mid-level specialists (colleges, technical schools);
  • management staff with higher education (university, institute);
  • teaching, scientific personnel (master's, postgraduate)

In Russia, a college is an educational organization that implements secondary vocational training programs. Unlike a technical school, in a college, in addition to educational programs of basic training, training also takes place in programs of in-depth study of disciplines. According to Art. 92 of Law No. 273-FZ of December 29, 2012 “On Education in the Russian Federation”, educational activities in educational institutions of this type are subject to state accreditation for the following programs:

A higher education institution is an educational organization that implements programs of higher professional education. Such organizations may be:

  • government;
  • private.

Belonging to a non-state educational institution in itself does not affect the ability to pay for studies with maternity capital. As in the case of college, the determining factors in the implementation of such an opportunity are the presence of:

  • licenses for the provision of educational services;
  • certificates of state accreditation with the attachment of accredited educational programs.

Such programs must meet educational standards in several respects:

  • number of teaching hours;
  • terms of study;
  • forms of education.

As for the educational programs being implemented, at a university, unlike an institute, they are represented more extensively in a variety of fields of knowledge.

According to the new law “On Education”, master’s and postgraduate studies are educational levels of higher education. At the same time, postgraduate study is a form of training for teaching staff of universities, and master's degree is a form of training for highly qualified specialists.

A significant difference between postgraduate studies and master’s programs, but not affecting the possibility of paying for tuition with maternity capital, is the fact that it can be established not only at a university, but also at:

  • scientific research institute (SRI);
  • another educational organization engaged in scientific research.

In order to use maternity capital, the child must be under 25 years old at the start of education, and this fact in the case of graduate school may not always be feasible due to the need to obtain a bachelor's degree (4 years of study) and a master's degree (2 years of study) before entering higher education. level of education.

Otherwise, if you have a license and state accreditation of educational programs, you can pay for master’s or postgraduate studies using the certificate.

An institution whose educational services are planned to be paid for using capital funds must certainly have a license and accreditation carried out in the manner established by the legislator.   • copy or original of the maternal certificate;

  • supporting documents for the right to provide educational services by a university or other educational institution;
  • if the contract is concluded with a non-state educational institution, it is necessary to provide a certificate of its state accreditation.

An application for the use of maternal capital can be submitted at the territorial office of the Pension Fund of Russia, and you can also leave a similar application on the State Services portal. In both cases, you must have the following documents with you:

Which institution can you pay for with maternity capital?

Parents can direct funds from MK to their child’s education in any licensed institution, including:

  1. Private and public preschool institutions.
  2. Higher educational institutions.
  3. Private schools and lyceums.
  4. Technical colleges and schools.

The main condition for providing payments from MK is the need to pay tuition fees. If an educational institution does not have a license, payment for its services from the certificate will be denied.

The management of the educational institution must agree to pay for services using funds from maternity capital. Otherwise, it will not be possible to process payments. According to the law, parents have the right to pay for their studies using a certificate, but if the management of the institution refuses to accept these funds, nothing can be done about it.

Agreement with an educational organization

When paying with maternity capital funds, a tripartite agreement is concluded. Parties to the tripartite agreement:

  • Performer – educational organization
  • Customer – parent, certificate holder
  • Learning child

The contract must list the paid services provided, as well as the amount and procedure for their payment.

Requirements for an educational institution

Basic requirements for the university:

From maternity capital funds you can pay for:

Concluding an agreement with an organization providing educational services

Such agreements can be bilateral or trilateral, depending on the number of interested parties and participants. In the case of children’s education, a tripartite form is used according to the number of participants:

  3. A student is a child in respect of whom a contract is concluded.

It is better to conclude an agreement in advance: a copy is included in the mandatory package of documents submitted to the Pension Fund. The verification will take at least a month.

  1. Full name of the educational institution, including state license number.
  2. Last name, first name and patronymic of the applicant and child.
  3. Cost of full training.

  5. Details of the recipient organization for transferring funds.

Submitting an application

An application for disposal of maternity capital funds is submitted in writing or electronically.   1. If funds are allocated to pay for paid educational services, then a copy of the contract for the provision of an agreement . The original agreement in the applicant’s hands and a copy of it that is not certified by the educational organization are not accepted by the Pension Fund of Russia. The contract must indicate the customer - the mother or father of the child, and the student - the child .
  2. To pay for the maintenance of a child, supervision and care for him in a kindergarten, it is additionally necessary to submit an agreement between the educational organization and the owner of the certificate , containing the obligations of the kindergarten for the maintenance and (or) supervision and care of the child (indicating his personal data), as well as the amount payment and settlement procedure.
  3. If MSC funds are sent to pay for living in a dormitory, it is necessary to provide a rental agreement for residential premises indicating the amount and terms of payment, as well as a certificate from the educational organization confirming the fact that the child is living in the dormitory.

If an organization provides a deferred payment in connection with the allocation of capital funds for the initial payment for tuition, maintenance, supervision and care, as well as accommodation in a dormitory, this must be reflected in the relevant contracts or in an additional agreement .

Procedure for paying for education with maternity capital

As noted above, in order to pay for the education of an older child with MK funds, you first need to conclude an agreement with the organization ; without a copy of it, the Pension Fund will refuse to transfer the money. It is better to do this in advance , since checking the information at the Pension Fund of the Russian Federation will take a month .

The contract for the provision of educational services must contain the following information :

  1. The name of the organization providing educational services, as well as the license number.
  2. Full name of the certificate owner and child.
  3. Full tuition fee.
  4. Deadlines for making payments and their amounts.
  5. Organization details.
  6. For organizations of secondary vocational education, a tripartite agreement is concluded, which specifies:

After the contract is concluded, the owner must submit an application and documents :

  1. To the territorial branch of the Pension Fund:
      personally or through a representative;
  2. by sending copies certified by a notary by mail, the owner will be sent a notice with the date of receipt.
  3. To the multifunctional center (MFC).
  4. Electronically (application only):
      through the account of the insured person on the Pension Fund website;
  5. through the State Services portal.

If the recipient of the certificate submits an application electronically , then no later than the next business day, the PRF will send a notification of receipt, which will indicate the date when you need to bring the necessary documents to the department. They must be submitted within 5 working days from the date of registration of the application for disposal.

Parents living outside the Russian Federation, if they have the right to MK, can pay for the education of their older child by sending documents directly to the Pension Fund.

If the Pension Fund makes a positive decision, then the capital will be transferred to the organization by non-cash method within 10 working days . If the owner of the certificate decides not to use maternity capital to pay for training, then within these 10 days he must submit an application for cancellation to the Pension Fund.

In some cases, the disposal of MK funds can be suspended or abandoned :

  1. According to Part 11 of Government Resolution No. 926 of December 24, 2007, if a child goes on academic leave, the certificate holder can submit an application for suspension and a certified copy of the leave order to temporarily stop payments. In addition, the question remains unclear whether MK can be used to pay for services provided by individual entrepreneurs , since they do not operate in the form of legal entities (organizations).

Can I pay for college?

It is possible to pay for college studies using maternity capital , since the law does not establish restrictions that would prohibit this. Maternity capital can also be used to pay for tuition in other institutions of secondary vocational education (technical school, college).

Studying at college is different in that a student can choose one of two areas of secondary education:

  • basic - 3 years ;
  • in-depth - 4 years .

Both of these areas can be paid for using a certificate, provided that the college is located on the territory of the Russian Federation and also has a license to provide educational services . Whether the chosen college is affiliated with the university or not does not matter.

How to pay for university studies with maternity capital?

Is it possible to pay for distance learning with maternity capital?

Law No. 256-FZ does not establish restrictions on the forms of education that can be paid for with maternity capital, which means the certificate funds can be used to pay for part-time . To do this, you need to conclude an agreement with an educational organization, in which, in addition to the cost, you must indicate the distance learning option. After this, the agreement with the application is submitted to the Pension Fund.

Maternity capital funds can be used to pay for not only part-time, but also part-time (evening) forms of education, if the chosen program requires it.

Supervision and care of children in a preschool educational organization

It became possible to transfer maternity capital not only for education, but also for paying for the maintenance, supervision and care of children in kindergarten not so long ago with the entry into force of Government Decree No. 931 of November 14, 2011 on amending the existing Rules. It is also possible to pay for the maintenance of a child in extended day groups at school.

The main condition for sending MSC to pay for a kindergarten is the availability of a license , while the institution itself must operate in the form of a legal entity and can be:

  • municipal;
  • departmental;
  • private.

To direct maternity capital to pay for kindergarten, it is necessary to submit to the Pension Fund a service agreement that meets a number of requirements:

  • the actual parties to the contract must be the certificate holder and the institution;
  • the text of the contract must contain obligations regarding the maintenance and (or) supervision and care of the child;
  • a specific amount must be indicated for a certain period, for example, a month, and not the cost of stay per day without indicating the actual volume of services provided;
  • The bank details of the institution must be indicated in full.

The family sending maternity capital to pay for kindergarten chooses the required frequency of transfer:

  • monthly;
  • quarterly;
  • lump sum for the entire year.

The first payment is transferred to the Pension Fund within two months from the date of submission of the application for disposal of MSC funds, the rest will be made in accordance with the deadlines specified in the agreement. All payments will be made by bank transfer.

Paid educational services for accredited educational programs

One of the conditions for directing maternity capital to paid educational services is the receipt of state accreditation by educational organizations for those programs for which it is planned to transfer certificate funds.

When choosing an institution where their children will study, parents should pay special attention to this fact, since the presence of accreditation of the organization itself does not guarantee the presence of such for all programs it implements . According to Art. 92 Federal Law No. 273 of December 29, 2012 “On Education in the Russian Federation”, the decision on state accreditation is made:

  • for basic general education programs of primary, basic, secondary education - in relation to each level separately;
  • for basic professional educational programs of higher and secondary education - for each group of professions, specialties and areas.

Since it is believed that education in Russia is free, in general, paid services in education include:

In each of the above cases, the owner of the certificate must write a statement of refusal to send maternity capital funds, indicating the reason. Upon completion of the academic leave, it is necessary to re-submit an application to the Pension Fund for the disposal of MSK funds, attaching to it a copy of the order on the student’s admission to study .

In addition to the fact that you can pay for the education itself using the certificate, the amount that it allows you to have can also directly pay for the child’s accommodation in a dormitory while he is receiving an education.

To do this, the person holding the certificate must appear at the university and enter into a rental agreement with it. Payment in this case will also be made by bank transfer, the funds will be transferred to the university account that you indicate in the contract.

The first payment will be received two months after you submit a corresponding application to the Pension Fund, and subsequent payments will be made according to the terms specified in the contract.

There is a list of grounds due to which the receipt of funds to the university account withdrawn from the maternal certificate may be stopped:

  • the student is forced to go on academic leave for health reasons or went on leave of his own free will;
  • the student dropped out of the university voluntarily or due to poor academic performance;
  • the student died.

If certain circumstances occur, you must notify the Pension Fund that you no longer need to transfer money

In each of the stated cases, the person holding the certificate must provide the Pension Fund with a refusal to transfer family capital funds , and in the requested refusal it is also necessary to indicate the appropriate reason.
