Is it possible to pay for a private kindergarten with maternity capital?

According to Part 1 of Art. 21 of Law 273-FZ of December 29, 2012, educational activities in Russia are carried out:

  • educational organizations;
  • organizations providing training;
  • individual entrepreneurs.

Parents can choose such an organization (must operate in the form of a legal entity ; it is not possible to pay for the services of an individual entrepreneur with maternity capital) that has the right to provide educational services, which is confirmed by the appropriate license. Payment to individual entrepreneurs for receiving educational services

Kindergartens operating as individual entrepreneurs have the right to provide services for the maintenance of preschool children. Legal status and the need for certain documents are their distinctive feature:

  • If educational activities are carried out directly by an individual entrepreneur, then he only needs a certificate of state registration .
  • If educational activities involve the involvement of teachers and the transfer of part of the functions of teaching children to them, then the individual entrepreneur will need a license to provide educational services .

It turns out that it is possible to pay for the educational services of individual entrepreneurs from maternity capital funds only if they have a license, but since they are not required by law to have one, almost no one makes an effort to obtain it.

Procedure

To use state family support funds as payment for a preschool educational institution, you must:

  • conclude an agreement with the institution on the provision of paid services;
  • submit an application to the Pension Fund.

Where to submit an application, and how to complete it correctly?


The application is submitted either directly to the local branch of the Russian Pension Fund, or through:

  1. Unified portal of public services of the Russian Federation.
  2. Multifunctional Center.

You can obtain an application form and fill it out correctly at the PRF or at the MFC.

The parent who submitted the electronic application will still have to visit one of these institutions within 5 days to provide all the necessary documents. You can make an appointment for a specific time through “Government Services”.

The application must contain:

  • Full name of the certificate owner and the child for whom the family capital is provided;
  • request to send funds to pay for preschool education;
  • list of attached documents;
  • date of filing and signature of the applicant.

What documents need to be attached?

A package of documents that must be attached to the application:

  • a copy of the service agreement concluded with the kindergarten, certified by the head, indicating the amount and procedure for payment;
  • a copy of the addendum to the agreement with payment calculations, indicating the current account, as well as information about benefits and discounts;
  • a copy of the child’s birth or adoption certificate;
  • a copy of the maternal certificate;
  • identification document of its owner;
  • copy of SNILS.

Nuances of drawing up a contract


Before concluding an agreement, parents should carefully study the license and charter of the preschool educational institution, and then contact the head. When drawing up a document, it is important to take into account a number of nuances :

  1. The parties to the agreement must be the preschool educational institution and the parent holding the certificate.
  2. The document must include:
      details of the kindergarten, as well as information about its charter and license;
  3. obligations to supervise and care for the baby;
  4. bank account to which money will be transferred;
  5. terms, amounts and payment procedures are detailed in a special section.

How to deposit money?

  1. Parents enter into an agreement with the kindergarten for the provision of paid services.
  2. They submit an application to the PRF with an agreement attached to it.
  3. They are awaiting a decision from the Pension Fund. The waiting period can be up to two months.
  4. After a positive decision is made, the notification received from the PRF is provided to the preschool educational institution.
  5. The first payment is due within 2 months, and then according to the schedule specified in the contract.

Important! Payment for the kindergarten is made with state support funds upon visiting and providing services exclusively through a bank account.

When drawing up an agreement, parents choose the frequency of payment themselves , and it can be made once a month, a quarter, or once a year. The agreement provides for the return to the Pension Fund of that part of the funds that remained unused due to the early termination of the contract.

Transfer deadlines

The Pension Fund makes the first transfer of money within two months after the decision is made, and subsequent payments are made at the frequency specified in the agreement:

  • one-time (for the whole year at once);
  • once a quarter;
  • monthly.

Is it possible to pay for kindergarten with maternity capital?

Since 2014, federal maternity capital has been allowed to pay for education at universities, schools and colleges. Since 2018, parents have the right to use funds to pay for preschool education until the child reaches the age of three. By law, payment is made for state institutions or private institutions. The main condition is cashless payment. Parents have the right to contribute funds for education not only for the child who has given the right to payment, but also for other children in the family.

It is important to take into account a number of features when allocating government support funds to pay for kindergarten. A general education organization must operate officially or be accredited if the institution is private. Otherwise, the Pension Fund will reject the application. A corresponding agreement is previously concluded. Payment with maternity capital (hereinafter referred to as MK) funds for individual entrepreneurs in this area is not provided for by law.

Compensation for kindergarten fees when using maternity capital


Municipal gardens receive part of the payment from the budget, and funds from the family capital repay the entire necessary amount, including developmental and educational activities.

When using family capital, parents do not receive compensation in monetary terms - simply the amount of payment for the garden is initially reduced by the calculated amount.

According to No. 388-FZ, starting from 2020, the amount of compensation is established by regional regulations, with the minimum percentage being:

  • 20 - for the first-born;
  • 50 - for the second child;
  • 70 - for the third and all subsequent children.

Advantages and disadvantages

The following points speak in favor of paying for kindergarten with benefits::

  1. The procedure does not require many documents.
  2. Registration is possible at a convenient time.
  3. Finance can be spent on any child in the family or even several.

Disadvantages of this use of subsidies:

  1. You can transfer money only by bank transfer.
  2. Sometimes you have to wait a long time for the Pension Fund's consent.
  3. The service does not apply to gardens that do not have the appropriate licenses and accreditation.

Is the right to a tax deduction still available?

According to Art. 219 of the Tax Code, it is impossible to issue a social tax deduction when paying for preschool education services with a maternal certificate.

Why can they refuse?


Refusal to pay for kindergarten from family funds is possible for the following reasons:

  1. The institution does not have an educational license.
  2. Lack of registration as a legal entity or bank account.
  3. The agreement is concluded with a person who is not the owner of the certificate.
  4. The application was written incorrectly.
  5. Not all documents were presented or errors were made in their execution.
  6. The cost of preschool education services in the contract is indicated for 1 day, but must be indicated for a year, quarter or month.

Can I spend money on other services for my child?

According to Federal Law No. 256 of December 29, 2006, the subsidy can be used to pay for the education of a child under the age of 25 in any educational institution of all levels of higher and secondary vocational education located in Russia, whose training programs have state accreditation. This applies to both government agencies and non-government organizations.

Government Decree No. 926 regulates the types of paid educational services that can be repaid using the certificate:

  • basic educational programs if there are not enough budget places;
  • additional programs;
  • special courses;
  • tutoring;
  • in-depth study of subjects.

When is a balance sheet required?

Financial assistance provided to families by the state can be spent partially and for different purposes. In this regard, situations arise when part of the money has already been spent, and in order to use the rest over time, you need to know their quantity.

Attention! A certificate of the balance of family capital can be obtained either through the State Services Portal or at the Pension Fund branch at the place of registration.

Where should I transfer the money?


In accordance with Federal Law No. 256-FZ of December 29, 2006, financial state aid can be directed for the following purposes :

  • payment for kindergarten;
  • children's education.

Is it permissible to withdraw the entire amount at once?

The benefit can be paid to a low-income family in a lump sum . State support funds can be spent in full at once, but only for specific purposes provided for by law.

Required documents

The composition of the package of necessary documents varies depending on the purposes for which the family capital will be used, but it must include:

  • statement on the disposal of funds;
  • MSK certificate;
  • a copy of the applicant's passport;
  • copy of SNILS.

Important! If the application is submitted not by the certificate holder, but by his authorized representative, then the passport of this citizen and a power of attorney for him will also be required.

Procedure


To manage maternity capital online, you need:

  1. Log in to your personal account on the PFR website www.pfrf.ru using the password and login from the Public Services Portal.
  2. Select the section “Maternity (family) capital.
  3. Click “Submit an application for disposal of MSC funds.”
  4. Select the Pension Fund at your place of residence and click “Save”.
  5. Indicate whether you are submitting an application personally or through a representative and click “Next step.”
  6. Enter the following details of the applicant (and representative, if any):
      FULL NAME;
  7. floor;
  8. SNILS card number;
  9. date and place of birth;
  10. citizenship;
  11. place of residence;
  12. passport data;
  13. phone number;
  14. E-mail address.
  15. Click “Next step”.
  16. Indicate the series and number of the certificate, when it was issued and by whom, and click “Next step.”
  17. In the list that appears, select for what purposes the funds are allocated.
  18. Specify the amount to be disposed of and “Next step” again.
  19. In the section “Information defining the right to dispose of MSC funds”, select the necessary items.
  20. Click “Generate application”.

Attention! Notification of acceptance of the application will be received in your Personal Account, and 5 days after its submission you need to contact the local branch of the PRF with all the necessary documents.
