Rural pensions increased by a quarter, but not for everyone

For the first time, an amendment to the law “On Insurance Pensions”, providing for an increase in the fixed part of the pension for rural pensioners with 30 years of experience by 25%, was adopted in 2013 - paragraph 14 of Art. 17 Federal Law No. 400. But the new norm did not come into force, as it was immediately suspended for one year. In 2014, Vladimir Putin, in his May decrees, ordered a review of the terms of pensions for agricultural workers. However, the presidential instructions remained unfulfilled. Subsequently, in 2016, Federal Law No. 428 of December 19 froze the regulatory act on the growth of pensions for residents of rural areas until the beginning of 2020. And on October 3, 2020, Federal Law No. 350 (Article 9) actually “ahead of schedule” gave the concept of “work experience in agriculture” legal meaning. Before this, old-age pensions for agricultural workers were established on the same basis as for urban workers.

Why they “harnessed” for so long, who was lucky and how much they gained, we will now look at.

Everything fell into place

Why we had to wait so long for what was promised is clearly explained by the anecdote:

– The news wrote that the tasks set in the May presidential decree may not be fulfilled. How to understand this?

- Ah, well, now everything has fallen into place.

In general, “there is no money, but you hold on.” When at the end of December 2016 the regulatory act on the growth of pensions for rural residents was frozen until 2020, the Russian Pension Fund calculated that such a decision would save: in 2020 - 17.5 billion rubles, in 2020 - 18.3 billion, in 2020 – 19.1 billion rubles. The reform, which increased the retirement period for Russians by five years, slightly disrupted the Pension Fund's plans to save public funds. The moratorium had to be lifted a year earlier. And already in 2020, 16.7 billion rubles were allocated from the budget for the “rural” supplement.

Who's lucky?

A 25 percent pension supplement is given to farmers who are assigned to pay an old-age or disability insurance pension if the following mandatory conditions are met:

1. At least 30 years of work in agriculture in a position that is included in the list (list) established by the government.
2. During the appointment period, you must be on a well-deserved rest.
3. Live permanently in a rural area.

List No. 1440 dated November 29, 2020 includes professions, specialties and positions in three types of production: crop production, livestock farming, fishing on state farms, collective farms, agricultural cooperatives, peasant farms, etc. In addition, there is a fourth section providing for periods of work in collective farms, state farms, machine and tractor stations, inter-collective farm enterprises, peasant farms, agricultural artels, which were carried out before January 1, 1992, without mandatory requirements for the position held.

Who can count on a raise

Pension legislation provides a number of benefits for certain categories.

The above persons are entitled to an additional individual point. The growth of this indicator is expressed in an increase in the amount of insurance payment.

Increasing employee experience leads to an increase in points, thereby the state encourages working people.

The official Internet portal of legal information has published a list of jobs, industries, professions, positions, and specialties approved by the government, according to which, from January 1, 2019, the size of the fixed pension payment for rural residents will be increased.

As Rossiyskaya Gazeta has already reported, the list includes more than 500 professions, positions and specialties of employees of agricultural enterprises, collective farms, farms engaged in all types of crop production, livestock farming, and fish farming. In addition, the list includes workers of all professions and specialties who worked at machine and tractor stations, intercollective farm organizations, and agricultural cooperatives.

The increase will affect not only ordinary agricultural workers, but also directors and deputy directors of state farms, chairmen of collective farms, heads of workshops and brigades, etc.

• For disabled people of group III, the value of the PV in 2020 to the disability insurance pension will be 2667.10 rubles, which means the additional payment will be assigned in the amount of 666.77 rubles.

Which categories of pensioners will receive an additional 25% payment?

An increase in pension by 25% of the fixed payment from January 1, 2020 will be assigned automatically if the following conditions are met:

1. A citizen must work at least 30 calendar days in agriculture in a profession provided for in the list established by the Government, subject to mandatory payment of insurance contributions to the Pension Fund.
2. Not currently carry out work or other activities for which pension insurance contributions are paid (i.e.

Work experience in agriculture

The length of service is calculated on a calendar basis. It may include five periods:

• periods of work and activity for which insurance contributions were calculated to the Pension Fund of the Russian Federation;
• periods of work and activities that were performed on the territory of the USSR before January 1, 1992 according to the provided list of positions;
• periods of work on collective farms, state farms, at machine and tractor stations, inter-collective farm enterprises, on peasant farms, which were carried out on the territory of the Russian Federation before January 1, 1992, without mandatory requirements for the position held;
• periods of receiving benefits for temporary disability, as well as periods of annual paid leave, both basic and additional;
• periods of child care up to one and a half years, but in total no more than six years.

If there is no entry in the work book, the enterprise has been liquidated and it is impossible to provide documents on transfers to extra-budgetary funds, witness testimony can legally confirm the length of service.

Those pensioners who, when applying for an old-age labor insurance pension, already had attested work experience in the agricultural sector exceeding 30 years, do not have to re-submit documents and write applications.

Supplement to pension for rural experience

The increase in pensions for agricultural workers consists of a 25 percent increase for citizens of the state who fall under the requirements imposed by law. Pensioners permanently residing in the village who have 30 years of experience in the agricultural sector can receive an increase. Attention! Additional payments for 30 years of experience in agriculture are due to persons who have been assigned an old-age pension. : once a year, a pensioner must come to the Pension Fund and write a statement that, having a residence permit in the city of Zavodskie Pipes, he actually lives in the village of Apple Blossom.

According to the above Rules, annual confirmation of the place of actual residence in a rural area is not required if a pensioner chooses to have his pension delivered by a postal service organization or another organization engaged in pension delivery.

Condition four: you are a non-working pensioner

You have the necessary experience, profession, and you live in a rural area, but you still will not receive an additional payment to your pension if you are officially employed.

The fact of official employment cannot be hidden from the Pension Fund, because the employer transfers insurance contributions from the salaries of its employees to the Pension Fund.

A little more detail about the other two conditions. A pensioner who does not carry out labor or other activities for which insurance premiums are paid to the Pension Fund is considered non-working. If a person gets a job, the “rural” bonus is removed from him. The payment will resume from the beginning of the next month after he stops working.

The same applies to “permanent residence in rural areas”. When moving to the city, a rural worker loses his additional payment; when he returns, he receives it again. We are, of course, not talking about cases of “staying”, but if the registration at the place of residence changes. But there is another tricky point in this issue, at least for some residents of the Don region.

As explained to “Krestyanin” in the PFR branch for the Rostov region, there is a separate article that when classifying an area as rural, OKATO - the All-Russian Classifier of Objects of Administrative-Territorial Division - is used to establish an increase. The second section of OKATO applies. In the region, pension fund specialists have identified six settlements, which seem to be like villages, but are located in the first section of OKATO. These are urban-type settlements. Namely: the village of Sholokhovsky in the Belokalitvinsky district, Glubokiy in the Kamensky district, the villages of Gorny and Uglerodovsky in the Krasnosulinsky district, Kamenolomni in the Oktyabrsky district and Ust-Donetsky in the district of the same name. These settlements are not classified as rural areas according to the classifier. Accordingly, residents of these villages will not receive an increase.

How will agricultural workers get an increase?

Increased security for citizens of retirement age is carried out without an application. This means that the interested person will not have to contact the Pension Fund with documentation to carry out legally significant actions. At the same time, such a situation is only possible when the fund has data on the Russian citizen’s work experience in agriculture and his residence in the countryside. If the information is available, then the recalculation will be done automatically and the elderly will not need to waste time and health standing in queues.

According to Art. 10 Federal Law No. 350, the income supplement is established from the beginning of the year. However, recalculation can be carried out until September 1 of the current year. This does not mean that funds accrued since January will, one way or another, be additionally accrued at the time of registration of the bonus and will be received one-time as compensation.

If the Pension Fund does not have the necessary papers confirming the eligibility of establishing an increase to the basic security, the elderly person will have to visit the branch and submit the missing documentation. This can be done at a time convenient for the person. At the same time, agricultural workers must remember that this action directly affects the date of assignment of the preference:

• if a rural employee applies during 2019, then additional material support is approved from the beginning of the current calendar period in which the application was made (from January 1).
• when submitting acts next year or later, the appointment will take place in accordance with the rules established by Art. 23 Federal Law No. 400. In accordance with the latter, circumstances make it possible to issue a privilege only from the month following the month of submission of documentation. For example, an agricultural worker brought papers on March 15, 2020. Thus, the increased pension will be issued from April 1 of the same calendar period.

The size of the “rural” increase

I would especially like to draw your attention to the fact that not the entire pension of a pensioner increased by a quarter, but only the fixed payment to the insurance pension.

The fixed part of the insurance pension in 2020 was 4,982.9 rubles. Since January 2020, the size of the fixed payment, taking into account the general indexation of insurance pensions for all, has increased by 7.05% to 5,334.19 rubles. 25% is calculated from this amount. The result is 1,333.55 rubles per month - for persons receiving payments for old age and disability of groups I and II; for citizens receiving disability insurance pension of group III – 666.77 rubles.

In Russia, according to government estimates, 1.2 million people received the bonus. In the Rostov region, 25 thousand pensioners fell into the “rural” category, of which slightly more than 24 thousand are unemployed.

Increasing pensions for agricultural workers in 2019

After the announcement of the first version of the pension reform, unprecedented negativity grew in society. Partly because of this, at the end of the summer of 2020, Putin made his address to citizens, in which he informed the population of the country about some relaxations regarding the standards of security in old age. This gave the villagers several reasons to improve their mood. Current pensioners living in the village will receive two types of increases .

Putin's indexing

Rural citizens are expected to receive an increase due to the indexation of security above inflation (approximately 1000 rubles).

In 2020, the 7.05% increase will only apply to unemployed persons.

For workers, they will, as before, be frozen until they stop working. Previously, the annual increase was carried out from February 1. From 2020, this date has been moved to January.

25% increase for long-term employees

The President decided to increase pension payments for this category of citizens by 25%. The allowance has existed since 2013 and was regulated by clause 14 of Art. 17 of Law No. 400-FZ “On Insurance Pensions”. But she was frozen. Now people who have worked in agriculture and remain in villages permanently will be paid a quarter more. This is fixed in law 350-FZ of October 3, 2020.

At first glance, it seems that the increase is significant, but the pension provision of citizens in this area is small. In addition, 25% is calculated not from the full amount, but from a fixed part of it. Deputy Prime Minister of the Russian Federation Tatyana Golikova announced that on average an increase of 1,300 rubles per month is expected .

A 25% bonus is given to persons who meet certain requirements :

• have worked in the rural sector for more than 30 years in the position provided for in the list;
• continue to live in the village;
• pensioners refused to continue working.

If they forgot about you

This can happen, and, judging by the numerous calls and letters to the editor of the newspaper “Peasant” from the Zavetinsky, Morozovsky, Peschanokopsky, and Oryol districts, it happened.

The fact is that recalculation for rural pensioners was carried out without application. Accordingly, someone could have been missed. In this case, you should first contact the territorial office of the Pension Fund. By the way, all our applicants did this, but they did not find understanding from local specialists. Then you should look for the truth even higher - send a letter to the OPFR in the Rostov region, make an appointment with them or call the hotline: 8 (863) 306-10-20.

Throughout this year, regardless of when a citizen declares himself or provides missing documents confirming his right to receive an increase in pension, the increase will be assigned to him with

January 1, 2020. If additional documents are provided in 2020 and later, the additional payment will be assigned only from the next month after the date of application.

Stages of increasing pensions for agricultural workers

The amendments have entered into legal force and provide additional preferences for village residents. Pensioners have received the right to receive assistance as part of the reform ongoing in the country. Changes for villagers are planned to be implemented in two stages:

1. From January 1 of this year, pensions have been indexed by seven percentage points. This will have a positive impact on the amount of subsidy received. The average planned increase is 1 thousand rubles. Thus, the Government is fighting inflation and trying to outpace the growth rate of the latter. However, it is worth remembering that such a privilege is provided only to unemployed elderly people receiving insurance payments.
2. For activities related to agriculture for more than thirty years, pensioners will be paid an additional payment of 25% of the fixed insurance pension. The appointment of this type of preference was already provided for by law. However, due to the difficult financial situation in the country, it has not yet been carried out.

Important! Not all persons interested in this will receive an additional quarter of the proceeds. Thus, appointments will be made only to those who have worked for the previously designated time in positions included in the list. Deductions are made in accordance with the procedure approved by Federal Law No. 350-FZ.
