Regulatory framework governing benefits for military personnel


Russian legislation is quite dynamic, especially in matters of providing social assistance to the population. Therefore, in order to keep abreast of the latest changes, it is better to always turn to the primary sources, which are the following legal acts:

Reasons for refusal

They can refuse to process documents only if the law 5-FZ “On Veterans” is violated.

1. Having served in certain military structures:

  • USSR Armed Forces;
  • RF Armed Forces;

2. Having insignia:

  • order;
  • medal;
  • honorary title of the USSR or the Russian Federation;
  • a certificate of honor or gratitude from the President of the Russian Federation;
  • departmental insignia.

3. Having military experience - from 20 years. Grace periods do not count towards this.

4. Became disabled during service due to:

  • injuries;
  • contusions;
  • mutilation;
  • diseases.

Note! In itself, a wound, mutilation, or concussion that does not lead to disability is not a basis for conferring the status of a veteran of military service.

If disability has been established, the military man can enjoy benefits even in the absence of insignia and 20 years of service.

5. There must be retirement. Active military personnel are not entitled to receive this status.

Military veteran certificate: how to get it and how long it is valid

To enjoy benefits, it is not enough to simply meet the above criteria. It is necessary to obtain documentary evidence of such compliance, namely a veteran’s certificate.

The procedure for issuing a certificate is determined by Decree of the President of the Russian Federation of May 19, 1995 N 501 “On approval of the procedure and conditions for conferring the title “Veteran of Military Service” and is as follows:

1. Writing an application to the personnel department at the place of duty . A serviceman who is already retired must send a report on his last place of service to the personnel or pension department. You can also get its template and sample there. For example, retired military personnel apply to the military commissariat, police officers - to the pension department of the Ministry of Internal Affairs, firefighters - to the relevant department of the Ministry of Emergency Situations, etc.

Social Security does not award military veteran titles - they only serve civilians.

It is best to fill out the application together with the employee who will accept it, since each department has its own specifics.

2. Attached to the application is a package of documents. For each case it is determined individually. In general terms, the applicant must add the following documents to the report:

  • passport;
  • work book;
  • confirmation of length of service (issued by the personnel department of the agency where the military man served);
  • certificate of disability;
  • ITU confirmation of the causes of disability;
  • awards and confirmation of conferring honorary titles.

Medals and orders must be provided with the order book included.

3. Waiting for a decision from the local administration. First, the documents are sent to the local administration - no more than 3 weeks are allotted for this according to paragraph 3 of the Decree, and then officials consider the issue of assigning status within a month. In total, this entire procedure takes almost 2 months.

4. Receipt of a ready-made certificate or a reasoned refusal to issue it. If the information provided turns out to be reliable, the central body of the department will prepare an order from the head on assigning the status and issue a certificate of the appropriate form. It will need to be obtained from the local administration against signature. The person issuing it will also put his signature. If there are no grounds for issuing a document, a written reasoned refusal will be sent.

The certificate is valid for an indefinite period, that is, it does not require renewal. It is also valid throughout the Russian Federation, that is, a veteran who received a certificate in Moscow can enjoy benefits based on it somewhere in Rostov or Novosibirsk.

When can I get a veteran's ID?

You can submit documents for assignment of veteran status at any time after entering the reserve/retirement. It depends on the wishes of the military pensioner himself.

Some believe that a veteran’s application and documentation should be submitted within the three-week period established by Decree of the President of the Russian Federation N 501. It is erroneous that this period is provided for military registration and enlistment offices, personnel services, etc., which accept documents from the applicant. And these services, within the specified period, must submit documents to the body that directly makes the decision on assigning the status.

Pensions and benefits: what social payments will increase in 2020

What benefits are available to veterans of the armed forces in the Russian Federation?

First, let's look at the preferences that all veterans are entitled to, regardless of their place of residence in the Russian Federation. They are established by federal acts and are formalized in the competent structures, each separately. There is no single body where it would be possible to register benefits for veterans of the Russian Armed Forces.

Tax benefits

They are established by the Tax Code and additional acts and are reduced to the following:

  1. Complete exemption from paying state fees in the courts. Veterans use this right when appealing to the Supreme Court, courts of general jurisdiction and magistrates with property claims, the amount of claims for which does not exceed 1 million rubles (Article 333.36 of the Tax Code of the Russian Federation).
  2. Full compensation for the paid amounts of land tax and property tax for individuals ( Resolution No. 941 of October 22, 1993). You can receive funds back from the territorial pension authority by providing a notification of tax payment and supporting payment documents.
  3. Benefits, payments and subsidies received by a veteran are not subject to personal income tax.
  4. Absolute exemption from property tax. Applies to property that is not used for profit (Article 407 of the Tax Code of the Russian Federation). It is established in relation to only one object of taxation at the choice of the veteran, namely in relation to:
      apartments or rooms;
  5. house or part thereof;
  6. utility premises;
  7. ateliers, creative workshops, galleries, etc.;
  8. garages or parking spaces.

To take advantage of the benefit, you must write an application to the tax authority and provide documents justifying the use of the benefit. It is also necessary to send a notification about the selected tax objects before November 1 of the current tax period.

Tax benefits after the death of a military veteran will be available to his widow/widower until they remarry.

Labor benefits

A veteran can choose the most convenient time for annual leave at his own discretion. As judicial practice shows, this right is absolute, that is, it does not depend on whether the vacation schedule has already been drawn up or not, and whether there is a veteran on this schedule at all. That is, judicial practice emphasizes the unilateral nature of the employee’s right to change the time of use of his vacation.

Medical benefits

  1. The right to go to any public hospital for free medical care. That is, a veteran can be treated for free by any doctor working in a government institution only upon presentation of an identification card. We are talking about examination, diagnosis, making a diagnosis, issuing a prescription, and carrying out medical procedures. If you are served in a private center, check whether they provide similar benefits. Some commercial organizations stipulate in their internal regulations the possibility of providing medical care on preferential terms. But this is their right, not their obligation.
  2. The right to free examination in public hospitals and clinics. We are talking about a study using special medical equipment - ultrasound, MRI, etc. No additional documents other than an identification card are needed to receive the benefit.
  3. Purchase of prosthetics or prosthetic and orthopedic goods and their repair at the expense of the state. This applies to both dentures and other parts of the body. But only if the prostheses are not made of metal-ceramics or precious metals - the state is not ready to bear such expenses. In this case, the installation of prostheses, that is, the operation itself, is paid for by the veteran at his own expense (unless otherwise provided at the regional level).

To take advantage of the benefit, you need to contact social security or the administration at your place of residence.

Benefits for housing and communal services

There is a lot of controversy surrounding the provision of this type of benefit in practice. The fact is that in Article 23.2 of Federal Law No. 5, military service veterans are not directly mentioned in the list of persons who are entitled to a discount on housing and communal services. But it lists other military personnel - combat veterans, veterans and participants of the Second World War, etc.

Due to the fact that such a benefit is not prescribed at the federal legislative level, conflicts arise in local social protection authorities. Especially if such preferences are not duplicated in a local law or other act. Veteran applicants are denied benefits and then go to court.

The courts side with military veterans, so they make decisions to provide benefits for housing and communal services.

A discount on utility bills is provided monthly in the amount of 50% of the amount indicated on the receipt. Veterans receive it in the form of compensation, that is, after the fact - after they have paid the full amount of housing and communal services. The funds go to the veteran's account.

Social benefits

This category of benefits includes pensions for veterans, as well as payment of social benefits:

  1. Reimbursement for veteran's funeral expenses . According to Article 24 of the Federal Law “On Veterans”, this includes the costs of transporting the body, its burial or cremation, as well as the installation of a tombstone. The burial is carried out taking into account the wishes of relatives, if any, in a solemn atmosphere with military honors. Relatives must contact the local social security authority or city/district administration to take advantage of the benefit.
  2. Payment of EDV . It stands for a single cash payment and differs in size in each region, since it is paid from the local budget and depends on the cost of living in the region.
  3. Receiving a housing subsidy . Regulated by Article 23.2 of Federal Law No. 5. However, to obtain it, it is not enough to have the appropriate certificate. It is necessary that the veteran be recognized as in need of housing in the prescribed manner. His candidacy must be included in the “queue”, which is maintained by the local executive authority (usually the housing department of the administration). However, the state allocates certain quotas, which means that not everyone receives a housing subsidy. It is paid on a first-come, first-served basis, that is, those who got in line first get it first. The subsidy has a specific purpose and is aimed at purchasing an apartment, house or part of a house.

Benefits for pensioners to pay for housing and communal services in 2020

The most important housing benefits for pensioners are provided based on a comparison of their income level and the amount of utility bills. So, if the latter is more than 22% of the pension or total family income, a discount on payment is prescribed.

Benefits for pensioners for housing and communal services in St. Petersburg, Moscow and other cities are assigned in almost the same manner, with the exception of programs developed at the local (regional) level. These may include a wider list of beneficiaries, but do not contradict the main regulatory act on minimum limits and requirements.

Benefits for military veterans by region

Each region has its own “set” of benefits for military veterans. They complement the federal benefits listed above and are used in conjunction with it. In 2020, an additional allowance of 1,000 rubles will be paid from the capital budget to the standard monthly allowance for military veterans.

But there is no transport tax benefit for them, unlike WWII and combat veterans. The tax is not paid only for a car with an engine up to 70 hp, but this rule applies not only to military veterans, but to all owners of low-power cars.

In the Moscow region

Benefits are established by the Law of the Moscow Region dated March 23, 2006 N 36/2006-OZ and are as follows:

  1. Receiving free dentures and their repair (without installation).
  2. Free services in medical institutions of the Moscow region.
  3. Providing funds to pay for landline telephone services in the amount of 220 rubles.
  4. Payment of half the cost of rent and contribution for major repairs.
  5. Monthly compensation in the amount of 50% of the cost of housing and communal services (cold and hot water supply, sewerage, electricity supply, gas supply (including the supply of domestic gas in cylinders), heating (heat supply), solid municipal waste management). At the same time, the Law does not say anything about providing this benefit to family members of a veteran, as is provided for in other regions.
  6. Free travel on buses, trolleybuses, trams with a social card for a resident of the Moscow region.
  7. Free travel on commuter trains (except for fast and high-speed luxury trains) with a social card for a resident of the Moscow region.
  8. Discount on travel on inland water transport in the amount of 50% of the cost.

You cannot travel on water transport with a social card - a discount will be provided upon presentation of a veteran's ID.

In St. Petersburg

Each veteran of military service living in St. Petersburg and over 60 years of age receives a monthly allowance of 911 rubles (including indexation for 2019). The fact of employment or receipt of income does not affect the ability to exercise this right, since this is not financial assistance, but a payment to veterans due to their preferential status.

In addition to the EDV, they are also provided with the following benefits in accordance with Article 62 of the Social Code:

  1. Payment of rent with a 50% discount.
  2. A 50% discount when paying for water supply and sewerage services, as well as electricity, gas, and heating. If a veteran heats a room with solid fuel, its supply is organized.
  3. Purchase of a monthly single discount ticket (for trams, trolleybuses, buses and metro) at a price equal to the size of the daily allowance.
  4. Travel annually from April 27 to October 31 on suburban railway transport with payment of part of the cost of a one-time trip from the local budget in the amount of 10% of the fare cost.
  5. Travel annually from April 27 to October 31 under similar conditions in commuter buses, the owners of which have entered into relevant agreements with local authorities.

Men will be able to use these benefits for military veterans after 60 years of age, that is, after reaching retirement age. Women who are endowed with this status can use them up to 60 years old - from 55 years old, but not earlier than that.

Novosibirsk

Law of the Novosibirsk Region N 253-OZ “On measures of social support for certain categories of citizens living in the Novosibirsk Region” dated December 29, 2004 does not contain a separate article devoted to benefits for military service veterans. However, this does not mean that there are no benefits at all.

The fact is that, according to Article 23 of the Federal Law of January 12, 1995 No. 5-FZ “On Veterans,” military service veterans are equal to labor veterans, and for them, Law No. 253-OZ allocates Article 5. According to its provisions, veterans of labor and military service living in this region enjoy an almost “standard” set of benefits:

  1. Receiving EDV.
  2. Manufacturing and repair of dentures.
  3. Compensation in the amount of 50% of the monthly cost of utilities.
  4. 50% discount on rent.
  5. Travel by suburban railway transport at 50% cost during periods determined by the Government of the Novosibirsk Region.
  6. Free provision of plots of land for gardening, summer cottage farming, and vegetable gardening.

In the Rostov region

In regional legislation, the status of veteran of military service = veteran of labor is also given, so the former enjoy the same benefits as the latter:

  1. Monthly cash supplement in the amount of 247 rubles.
  2. Compensation of 50% for using a landline telephone.
  3. Free trips to sanatoriums if indicated, with compensation for transportation costs.
  4. A personalized travel card that allows you to travel free of charge on public transport. And if a veteran lives in a rural area, he can also use it in intercity transport. The exception in both cases is a taxi.
  5. Paying half the fare on trains.
  6. Refund of half of the paid monthly cost of utilities and rent. In the Rostov region, unlike other regions, this benefit also applies to able-bodied family members living with a veteran.
  7. A 50% discount when purchasing fuel during the heating season, if the housing is not gasified.

Free dental prosthetics and denture repairs in public clinics - these benefits are also sponsored by local authorities from the regional budget.

Voronezh region

Law of the Voronezh Region “On social support for certain categories of citizens in the Voronezh Region” dated November 14, 2008 N 103-OZ in Art. 24 provides for this category of persons a monthly cash payment in the amount of 386 rubles.

In addition, they are given a 50% discount on rent, housing and communal services and the purchase of solid fuel.

In Krasnodar region

The Law of the Krasnodar Territory “On measures of social support for certain categories of residents of the Krasnodar Territory” dated December 8, 2004 establishes the following preferences:

  1. EDV in the amount of 220 rubles.
  2. 50% compensation for rent. This discount can be used not only by the veteran himself and his dependents (disabled persons), but also by parents, children, and spouse who live with him.
  3. Compensation in the amount of half the monthly payment for utilities.

  • labor veterans and military service veterans;
  • labor veterans and military service veterans of pre-retirement age (55 years for women and 60 years for men), who received status in order to provide additional measures of social support and provided that cash income for 12 months does not exceed one million eight hundred thousand rubles;
  • home front workers;
  • rehabilitated persons who were subjected to political repression;
  • persons who suffered as a result of political repression.

Who is entitled to the monthly city cash payment?

  • a document proving the identity and place of residence of the applicant in the city of Moscow;
  • pension certificate or other document confirming the fact of receipt of a pension or lifelong allowance (if you receive a pension not at the branch of the Pension Fund of the Russian Federation in Moscow and the Moscow region). If labor veterans or military veterans of pre-retirement age apply for payment (55 years for women and 60 years for men), you will need a certificate of income for the 12 months preceding the month of application for a monthly city cash payment;
  • a document confirming the right to a benefit (if the document has not previously been submitted to the social protection authorities of the city of Moscow);
  • a certificate (information) about non-receipt of a monthly cash payment from the federal budget (if you receive a pension not at the branch of the Pension Fund of the Russian Federation in Moscow and the Moscow region);
  • a document confirming the change of name (if the full name does not match in the documents specified in the previous paragraphs, if the document was issued by the civil registry office not in Moscow or in Moscow, but before 1990).
