Who is a participant in the fighting in Chechnya

The status of participant in hostilities is assigned to both demobilized conscripts and contract soldiers and officers. In particular, the current legislation determines that participants in hostilities in the Chechen Republic include:

  • soldiers and officers who served in fixed-term and permanent service in Chechnya;
  • persons who participated in armed conflicts on the border with the Chechen Republic;
  • military personnel sent to Chechnya to perform combat missions;
  • civil servants sent to Chechnya during the war;
  • military personnel sent to military units to perform certain duties.

Certificate

The certificate is the main document confirming the status of a veteran of military operations in Chechnya.
That is why you must obtain this document before applying for benefits or payments. According to the Law “On Veterans”, the following can receive it:

  • military personnel sent to the Chechen Republic to perform tasks in conditions of armed conflict in the Chechen Republic and in the adjacent territories of the Russian Federation, classified as an armed conflict zone from December 1994 to December 1996;
  • military personnel sent to perform tasks during the counter-terrorism operation in the North Caucasus region since August 1999.

Participants in combat operations on the territory of Chechnya can receive the status of Combat Veteran or Military Service Veteran, depending on their compliance with certain criteria, or choose the most “beneficial” one for them. The most extensive list of benefits is expected for combat veterans.

Monthly cash payments

The state budget for 2020 provides cash payments to veterans of military operations in Chechnya in the amount of 2,900 rubles monthly.

The expenses are charged to the account of the Pension Fund of the Russian Federation, and it is there that the veteran should apply for receipt.

The processing time for the application is ten days, during which the pension fund is obliged to accept or refuse to issue the EDV.

Both working and non-working veterans are eligible to apply for this type of payment. Pensioners will receive the EDV amount along with their pension, and working veterans will receive it on the day designated by the pension fund. Moreover, in the event of the death of a veteran, his close relatives (children, parents, spouse) have the right to demand payment of the EDV due to the deceased or deceased.

Regulatory framework and latest changes for 2020

The procedure for payments and the determination of persons covered by the program are regulated by Art. 3 Federal Law No. 5 “On Veterans”. This document contains the most complete list of conditions under which a person is entitled to receive the status of a combat veteran.

Potential applicants include military personnel and employees of the Russian Ministry of Defense, sent by the government to hot spots to participate in hostilities or perform special tasks, in accordance with their type of activity both in the country and abroad. Transport tax

In matters of car taxes, the fate of the veteran is decided by regional government structures, to which the state has delegated the right to establish, modify and remove transport tax benefits. Accordingly, jurisdiction extends only to the region of residence of a particular combat veteran in Chechnya.

As a general rule, in most regions tax incentives are applied depending on either the manufacturer of the car or the size of its engine. At the same time, there is a limit on the number of vehicles owned. Due to this restriction, the right to transport tax benefits will apply to only one car, and the second car will be taxed in full.

Thus, in St. Petersburg and the Leningrad Region, veterans are exempt from paying transport tax only if they own a domestically produced vehicle with a capacity of up to 130 horsepower.

How to obtain the status of a combat participant?

To obtain status, you must register with the military registration and enlistment office at your place of residence. In order to start the procedure for obtaining status, you need to prepare documents such as:

  • passport of a citizen of the Russian Federation;
  • military ID;
  • official papers confirming the presence of injuries during service in Chechnya;
  • documents for awards received for military service in the Chechen Republic;
  • flight book (for Air Force personnel);
  • an extract from documents confirming rank and appointment to a military position;
  • a certificate from the archive confirming the serviceman’s participation in battles (if necessary).

The military registration and enlistment office may request the personal file of a serviceman from the unit where he served or rely on documents that are at its disposal. It is usually more difficult for a former conscript to confirm his status than for a career military man.

Regarding the assignment of status, a meeting of a special central commission of the military district is scheduled. The decision must be made within 30 days from the date of filing of documents. If it is positive, then the applicant is issued a combat participant ID. After this, you can begin processing benefits and payments.

Pension for combatants in Chechnya

Participants in combat operations are not entitled to a separate pension. A citizen can apply for one of the types of pensions provided for by law as soon as he becomes entitled to it. Pensions are:

  • by length of service of military personnel;
  • on disability of military personnel;
  • old age insurance;
  • social;
  • for loss of a breadwinner (for family members of a combatant).

To apply, depending on the type of pension, you need to contact the military commissariat or the Pension Fund (PFR) at your place of residence. Documents are reviewed within 10 days. The pension and all required additional payments are assigned from the moment the right to payments is obtained.

The size of the pension depends on various factors:

  • duration of service;
  • the type of pension provision itself;
  • military rank and position;
  • region of residence of the pensioner;
  • presence of government awards;
  • disability groups.

In 2020, the minimum pension for a combat participant is 11,220 rubles. This amount is calculated from the minimum social security and mandatory social payments. By virtue of Article 45 of Federal Law No. 4468-I of February 12, 1993, combatants are entitled to a pension supplement in the amount of 32% of the fixed part of the social pension. In 2020, this premium will be:

5034.25 x 32% = 1610.96 rubles

For those pensioners who permanently reside in the Far North and equivalent regions, increasing coefficients are applied to their pensions.

The right to a long-service pension is granted to citizens who:

  • the duration of mixed service is at least 25 years, of which at least 12.5 years are in military service;
  • the total length of service is at least 20 years.

A serviceman who was wounded or concussed during military operations, which resulted in disability, is entitled to a disability pension. Its size depends on the disability group:

  • Group I – 3137.60 rubles;
  • Group II – 2240.70 rubles;
  • Group III – 1793.70 rubles.

All pension payments are subject to annual indexation. In 2019, such indexation will be:

  • 7.05% for old-age insurance pensions (from January 1, 2019);
  • 2.4% for benefits and social payments (from February 1, 2019);
  • 6.3% for military pensions (from 1 October 2020).

Replacing benefits in kind with cash

Benefits granted to veterans and their dependents can be received either in kind or converted into cash. This initiative has only recently appeared. Now combatants have a choice in what form they prefer to receive their bonuses and payments from the state. This is convenient in that most veterans do not receive the full benefit package in kind.

Coins and paper money

Almost every benefit has its own monetary equivalent, fixed in federal law. The most common types of compensation are:

  • free travel on public transport,
  • health treatment in sanatoriums,
  • services in clinics without an appointment.

To request monetary compensation, you will need to personally submit an application to the Pension Fund no later than the end of October of the current year. The changes will come into force only next year, and then it will be possible to receive funds.

Not all benefits are subject to monetary compensation. For example, the possibility of obtaining a land plot intended specifically for the construction of a residential building is not subject to compensation.

Benefits for participants in combat operations in Chechnya

Those who have a certificate of combat participation are entitled not only to an increased pension, but also to various benefits. In particular, veterans of the Chechen campaign are entitled to receive:

  • tax benefits in the form of a reduction in land and real estate taxes and complete exemption from transport tax for one vehicle, regardless of its capacity;
  • additional paid leave lasting 15 days (if the person is working);
  • additional unpaid leave of up to 35 days;
  • social package of services;
  • free land plot for individual residential construction;
  • free travel on public transport in any city in Russia;
  • 50% discounts when paying for housing maintenance and utilities;
  • extraordinary installation of a landline telephone;
  • free dental prosthetics;
  • free training in educational institutions and advanced training courses;
  • entry out of turn into gardening partnerships and building cooperatives;
  • free visit to a health resort or health resort once a year;
  • free travel to the place of treatment if you have a referral from the attending physician;
  • purchasing vouchers for sanatorium-resort treatment with discounts of up to 70%.

The procedure for obtaining preferential status, the specifics of early retirement, the list of benefits and other social support measures are regulated by Federal Law No. 5-FZ of January 12, 1995 and Federal Law No. 400-FZ of December 28, 2013.

EDV for veterans of Chechnya

Participants in combat operations have the right to assign and receive monthly cash payments (MCP) in the amount of 2869.72 rubles. To register, you must contact the territorial branch of the Pension Fund and provide:

  • statement;
  • passport of a citizen of the Russian Federation;
  • ID card of a participant in hostilities;
  • SNILS;
  • bank account details for transfer.

In fact, this is monetary compensation for the veteran’s set of social services:

  • for medical supplies – 811 rubles;
  • for sanatorium-resort treatment – ​​125 rubles;
  • for free travel – 116 rubles.

Providing housing at the expense of the state

Veterans of Chechen campaigns are provided with one-time payments for the purchase or construction of housing. In addition, many regions have regional benefits, including a 50% discount (or rather, reimbursement of costs from the regional budget) on rental housing, contributions for major repairs and payment for housing and communal services. At the same time, the amount of additional payments for war invalids will be higher.

The monthly allowance of military personnel is not subject to personal income tax, but other income is subject to a standard deduction in the amount of 500 rubles. Veterans are also exempt from paying state fees when appealing to the Supreme Court if the claim is within the framework of the law on veterans. Some regions also have benefits for paying transport taxes.

Getting housing

Obtaining ownership of residential premises or funds for its acquisition is carried out in the manner established at the federal level.

In this case, the citizen must be recognized as needy .

The established area norm is 18 square meters. It is possible to purchase housing of a larger size, but the federal budget will pay only as much as is required according to the norms of the Ministry of Construction, taking into account the average market value of a square meter of housing in a particular region.

To obtain housing, you must contact the Administration at your place of residence with a package of documents. If a veteran of Chechnya is not recognized as needy, then the placement will not be carried out, and housing or funds will not be allocated for him.

Obtaining a land plot

The legislation provides for the receipt of a garden or vegetable plot of land from the land fund of the region. The allocation of a plot occurs on a first-come, first-served basis and there cannot be any replacement for cash.

To obtain land, you must contact the Administration at your place of residence.

Cash payments

The VBD of Chechnya is entitled to monthly payments, the amount of which depends on what services from the NCU (set of social services) the citizen used. The cost of each individual service is deducted from the monthly benefit, while the citizen is allowed to refuse benefits in whole or in part and receive benefits in cash. To do this, you need to send a corresponding application to the Pension Fund.

The total benefit amount is indexed annually. In 2020, payments will be indexed by approximately three percent. After last year’s increase in benefits by 2.5%, the amount of one-time payments for combat veterans is equal to 2,850 rubles. per month. It is important to understand that we are talking specifically about those direct payments that a veteran is entitled to receive if he refuses other social preferences.

Targeted loan

In a number of regions, loans are provided on favorable and preferential terms, according to which a veteran of Chechnya can receive funds for the construction or purchase of housing.

Such loan offers are an initiative of banks; there are currently no government programs to subsidize mortgage rates. Therefore, to clarify the details, you need to contact a specific bank.

In addition, if a combat veteran participated in the savings mortgage system program, he may qualify to receive funds to improve his living conditions with the support of the military mortgage system.

Not all banks cooperate with such a state program, among them we can note: Sberbank, VTB, Gazprombank, Otkritie Bank, etc.

Medicine

Another type of benefit for military veterans is the provision of free emergency care in public medical institutions to which the beneficiary is assigned on a territorial basis, preferential medications, referrals to medical institutions, free prosthetics and orthopedic products (with the exception of dentures).

If a beneficiary purchased a prosthesis at his own expense, the state reimburses the costs. However, a veteran can only count on receiving them after retirement.

The advantages of the benefits are that district hospitals and clinics do not have the right to refuse medical support to a person, even out of turn. In addition, a veteran can see a doctor without an appointment.

Transport benefits

Like housing and communal benefits, transport benefits are determined at the level of the municipal administration, and not at the federal level. For example, in the Moscow region, veterans are entitled to free travel on any type of municipal transport, with the exception of taxis.

Benefits for housing and communal services for combat veterans

To reduce the financial burden on veterans of military operations in Chechnya, benefits are provided for paying for housing and communal services:

  • 50% discount on major repairs;
  • discount on housing and communal services or provision of compensation;
  • compensation for payment of the cost of solid fuel for citizens who live in rural areas and in a non-gasified home;
  • discount on gasification at home.

It is worth noting that the costs of providing these benefits are borne by the municipality. However, in some areas, some benefits are not valid on the basis of internal legal acts. Housing

Housing benefits include free provision of housing or land, as well as other privileges:

  • providing a WBD family with housing if it is recognized as in need of improved living conditions.

Utilities

According to the law, WBDs can enjoy a 50% compensation when paying for utilities, as well as install landline telephones for free. Some regions provide compensation for the use of communication services.

Social

Other government guarantees

Among other things, federal legislation guarantees citizens who are veterans of military operations in Chechnya a number of benefits and rights:

Do not forget that in each region there are preferential queues for housing, and the veteran will take a place in it among those equal to him in terms of benefits. Thus, the process of obtaining housing may be delayed.

To register, a veteran will need to prove the need for improved housing conditions on a general basis.

Preferential housing includes the allocation of a land plot to a veteran for residential construction. In this case, payment for 18 m2 will not be made, since the land plot is given to the veteran free of charge. Important! When allocating a plot of land, the regional government authority sets a period during which the veteran must begin construction. If this deadline is violated, the land plot is confiscated.
